Safety, Risk & Liability
1. Assumption of Risk
Fishing and outdoor recreational activities on private property carry inherent risks, including but not limited to drowning or water hazards, slipping or uneven terrain, wildlife and insect encounters, weather exposure, and equipment use. By booking or hosting through Pond Pass, you voluntarily assume these risks.
2. No Inspection or Guarantee
Pond Pass does not inspect, verify, or guarantee the safety, condition, or legality of any pond, property, or amenity listed on the platform. Hosts are solely responsible for the condition and safety of their own property. Guests are solely responsible for their own conduct and safety precautions while on a host's property.
3. Pond Pass Is a Marketplace, Not a Party to Your Visit
Pond Pass connects hosts and guests through the app. Pond Pass is not present at, does not supervise, and is not a party to the actual property visit or fishing activity that takes place between a host and a guest.
4. Release of Claims Involving Other Users
To the fullest extent permitted by law, you release Pond Pass from claims, injuries, damages, or losses arising from the acts, omissions, or property of another user — including a host's property conditions or a guest's conduct. Disputes, injuries, or damage arising from a booking are between the host and guest involved.
5. Limitation of Pond Pass's Liability
To the fullest extent permitted by law, Pond Pass's total liability for any claim relating to the platform is limited to the amount of fees you paid to Pond Pass in the 12 months before the claim. Pond Pass is not liable for indirect, incidental, or consequential damages.
6. Indemnification
You agree to indemnify and hold Pond Pass harmless from claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the platform, your listing, your violation of these terms, or your interaction with another user.
7. No Warranty
The platform and all listings are provided "as is" and "as available," without warranties of any kind, express or implied.
8. Governing Law
Pond Pass is operated by Vaunts LLC. These terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

Terms of Service
1. Acceptance of Terms
By creating an account or using Pond Pass, you agree to these Terms of Service, our Privacy Policy, and our Safety, Risk & Liability terms. If you don't agree, please don't use the app.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use Pond Pass. By creating an account, you confirm the information you provide is accurate and that you meet this age requirement.
3. What Pond Pass Is
Pond Pass is a marketplace that connects guests looking to fish with hosts who offer access to private ponds. Pond Pass is not a party to any booking, does not own or operate any pond, and is not responsible for the condition of a host's property or the conduct of any user.
4. Contact Information Requirement
Before listing a pond or paying for a booking, you must provide your full legal name and phone number. This is required once and used for accountability between hosts and guests in an actual booking — see our Privacy Policy for how this information is shared.
5. Bookings & Payments
Guests request a booking, which a host may approve or decline. Some listings have "Instant Book" enabled by the host, in which case a booking request is automatically approved and the guest can pay immediately without waiting for host review. Approved bookings require payment before they're confirmed. Pond Pass charges hosts a commission (currently 10%) deducted from their payout, and charges guests a separate service fee (currently 5%) added to the listed price at checkout; payments are processed by Stripe, and hosts are paid out to their own connected Stripe account.
6. Cancellations & Refunds
If a guest cancels a paid booking more than 48 hours before the fishing date, they receive a full refund. Cancelling within 48 hours results in a 50% refund. Once the fishing date has passed, the booking is no longer eligible for a refund. If a host cancels an approved booking, the guest always receives a full refund regardless of timing.
7. Host Responsibilities
Hosts are responsible for the accuracy of their listings and confirming they have the legal right to grant access to the property. Hosts are responsible for the safety of their property to the extent required by applicable law.
8. Guest Responsibilities
Guests agree to follow any rules set by the host, respect the host's property, and comply with all applicable fishing laws and licensing requirements in their area.
9. User Conduct
You agree not to harass, threaten, or defraud other users, misrepresent yourself or a listing, or use Pond Pass for any unlawful purpose. Users can report or block other users who violate these terms.
10. Reviews
Reviews must reflect a genuine experience with a real booking. Fake, misleading, or retaliatory reviews are prohibited and may be removed.
11. Limitation of Liability
Pond Pass is provided "as is." To the fullest extent permitted by law, Pond Pass is not liable for injuries, property damage, or disputes arising between guests and hosts. Users interact with each other and use pond properties at their own risk. See our Safety, Risk & Liability terms for full details.
12. Account Suspension & Termination
Pond Pass may suspend or terminate an account that violates these terms, including for fraud, harassment, or repeated policy violations.
13. Dispute Resolution & Arbitration
Except for disputes that qualify for small claims court, you and Pond Pass agree to resolve any dispute arising from these terms or your use of Pond Pass through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. You and Pond Pass each waive the right to a jury trial and to participate in a class action or class arbitration. You may opt out of this arbitration agreement by emailing supportpondpass@gmail.com within 30 days of first agreeing to these terms; if you opt out, disputes will instead be resolved in the state or federal courts located in Missouri. This section is governed by the Federal Arbitration Act.
14. Changes to These Terms
Pond Pass may update these terms from time to time. Continued use of the app after a change means you accept the updated terms.

Privacy Policy
1. Information We Collect
We collect the information you provide directly: your email, date of birth, profile photo and display name, full legal name and phone number, pond listings, messages, reviews, and payment-related identifiers from Stripe. We also collect approximate device location if you grant permission.
2. How We Use Your Information
We use your information to operate bookings and payments, show distance to nearby ponds, connect guests and hosts through messaging, display reviews, verify your identity for accountability purposes, and maintain the safety and integrity of the platform.
3. Information Sharing
A host and guest can see each other's email and messages once a booking is created between them. Your full name and phone number are only shared with the other party once you have an actual paid booking together — not before, and not with anyone you haven't transacted with. Payment details are handled directly by Stripe; Pond Pass does not store your full card number. We do not sell your personal information.
4. Exact Addresses
A pond's exact address is only shared with a guest after they've paid for a booking at that pond. Before that, only the general town/area is shown.
5. Location Data
If you grant location permission, we use your device's approximate location to show distance to ponds and support distance filtering. You can disable location access at any time in your device settings.
6. Data Security
We use industry-standard providers to store and process data: Firebase (accounts, listings, messages), Stripe (payments), and Resend (delivering transactional emails like booking notifications, message alerts, and verification emails). No system is completely secure, and we can't guarantee absolute security.
7. Your Choices
You can edit or delete your profile information, and delete your account entirely, from Profile > Settings in the app. Deleting your account removes your profile data; it does not automatically remove listings, bookings, or reviews tied to past activity.
8. Children's Privacy
Pond Pass is not intended for anyone under 18, and we don't knowingly collect information from anyone under 18.
9. Changes to This Policy
We may update this Privacy Policy from time to time. Continued use of the app after a change means you accept the updated policy.
